We create ORIGINAL works, whether photographic, videographic or cinematographic works or projects. These works are copyrighted by the owner (Vicente Porfilio) of EL CLAROSCURO Films, and are protected by the intellectual property law.
The user and/or visitor of this website undertakes to respect the intellectual property rights of the website and its owner.
Pursuant to the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, copying, distribution, commercialization and public and/or private communication, including the method of making available, of all or part of the contents of this website, on any medium and by any technical means, without the authorization of the owner, is expressly prohibited.
Authorized
Our clients, that is, the person, people, groups or entities photographed and/or filmed by El Claroscuro Films are authorized to post, publish and reproduce –under the terms agreed by both parties– the corresponding works. In no case this authorization eliminates our authorship and does not allow them to commercialize our rights as authors.
How to use our images, photographs or videos?
Our work (photographs, videos, films, etc.) is made for our clients, that is, they are third parties, a person, people, groups or entities. Therefore, in order to use these works (whatever format and/or media), the corresponding license is required, as well as our authorization as authors of the works and, depending on the work, also the authorization of the person, people, entities, companies or groups that appear in it.
Therefore, it is essential that you request authorization by contacting us.
Individuals, groups or entities that obtain our license and/or authorization must visibly indicate ownership of the work or works through texts or writings that indicate this, and/or links and tagging on social networks and websites. These texts and links must refer to “El Claroscuro Films” as the author and owner of the copyright and the image.
The music of our videos and films
At El Claroscuro Films we have a license from Artlist and Morning light Music for the use of professional quality music (royalty-free) with authorization for commercial use. This music is what we use in the videos and audiovisual documents that we create for our clients. Therefore, the copyright of these works is respected both by us and by our clients, who can use this music thanks to our license.
In some cases, the authors of these platforms do not allow the use of their music if the intention is to monetize it (for example on YouTube). Therefore, in these cases it is necessary to use music expressly authorized by its author, or to use music from the YouTube library, for example.
Original Music and Scores
At El Claroscuro we collaborate with prestigious composers to create original music and scores for projects that require it. These authors, of course, through a written agreement, cede the corresponding rights so that our clients can use that music.
Music videos
In the case of the Music Videos we make, it is our clients who provide the musical themes (including lyrics and arrangements, if any). It is our clients who hold – or could hold – the corresponding copyrights and/or author rights to these themes, arrangements or music.
We, of course, hold the copyright to the images and the editing works that make up the video clip, as well as the covers and frames that can be extracted from them.
